Business Law BookIf you own, run, or manage a small- or medium-sized business, we understand that your life is as busy as it can possibly get. The last thing you need is a problem or lawsuit to slow you down, cost you money that you don’t have, and distract you from what you need to focus on: running and growing your business. Unfortunately, not every business relationship is a good one, and occasionally conflict arises. Whether a customer complains or a vendor neglects to do what it was contracted to do, legal issues arise all the time while running a business. It is therefore helpful to have a basic understanding of what business litigation is and when you should talk to an attorney.

What Is Business Litigation?

Business litigation is the area of law that relates to disputes that occur in commercial and business relationships. Business disputes can arise in many circumstances, such as when two partners decide that they no longer wish to be in business together, when customers claim that they didn’t receive what they paid for, or when two businesses disagree on the language contained in a contract.

Business litigation doesn’t necessarily mean that you need to sue someone and go to trial. Regardless of how wronged you may feel or how much you want to defend your honor if someone accuses you of something, it’s usually in your best interest to do everything possible to resolve your dispute without involving the court system.

The first step in most business disputes is try to work out a resolution, even if that means both parties have to give up a little bit of what they may be entitled. This can be painfully frustrating but may be the best decision for the business and you personally. But, if your disagreement can’t be resolved amicably, it’s important to consult a lawyer who focuses in the area of business litigation. Depending on your county, lawyers who practice in this area of law offer have different local courtroom rules and work routinely with clerks that are dedicated to “business court”.

Do I Need a Business Lawyer?

If you’re in business and one or more of your partners or investors wants out, or there is some sort termination of the business, you need a lawyer. If someone owes you a large sum of money and refuses to pay, you may need a lawyer. If someone claims that you owe him or her a large sum of money or a product that is worth a large sum of money and you disagree, you may need a lawyer. And if someone you are dealing with in any business-related capacity retains a lawyer against you, you may need a lawyer. Basically, any time you feel that a business situation is spiraling out of control in a way that could cost you a lot of money, time, or peace of mind, it’s wise to consider consulting an experienced business litigation attorney. It may be the consultation is all you need.
